  Last Will may prevail over earlier Will:- In case of dispute between earlier and subsequent parts of a Will,the subsequent part of the Will will prevails ( Kaivelikkal Ambunhi & ors vs H.Ganesh Bhandary,(1995) 5 SCC-444 & Uma Devi Nambiar & ors vs TC Sidhan,( 2004) 2 SCC-321. In case of “ Jasbir Singh vs Jaspal Singh & ors ”,2016 SCC Online P & H-3416,it   was held that the last will would prevail and the previous Will automatically deemed to have been cancelled, even in the absence of any specific clause.

          “It is human nature to be human & as a result, no one wants to indulge in undesirable activities or commit crimes knowing full well the consequences of such evil actions. But still many indulge in committing crimes by the force of destiny or fate.


              Death is the only truth of life. It is inevitable. Those who do not believe in God do believe in death. Life & death are acts of the devine and the devine’s authority has been delegated to the human courts of law to be only exercised in exceptional circumstances with utmost caution. The first and foremost effort of the court should be to continue the life till its natural end and the delegated devine authority should be exercised only after arriving at a conclusion that no other punishment but for death will service the ends of justice.However, most of the wise men believe that the unrevealed hour of death for each one of us is fixed by God, but what when the hour of death is fixed by Judge?

              When the mind is subjected to control, both sets or organs, namely, organs of senses & organs of action will be under control. A man commits guilt on account of uncontrolled action of his organs of senses & if he keeps them under control, he sure to attain success in life. A person whose speech & conduct are pure, gains success”.




              It is generally considered that Capital Punishment is cruel, inhuman & degrading. Sentencing someone to death denies him the right to life enshrined in the Universal Declaration of Human Rights. Countries which execute commonly cite the death penalty as a way to deter people from committing crime. But it is doubtful whether death penalty is any more effective in reducing crime than imprisonment. A majority of the countries have already abolished the death penalty, according to the Amnesty International.

              On the other hand, Life Imprisonment is a harsh sanction that is used in many parts of the worlds. Hundreds of people are serving life sentences, & yet it has merely been assessed as a global phenomenon.

              Justice V.R.Krishna Iyer has left us on 4th December, 2014.He has written many books mainly on jurisprudence. But there is only on book which is not on law,”Death and After” wherein he has written about life after death.

              According to him life and death live together and in a sense, are even complementary to each other. In the book he has stated real experiences about his communication with his wife.
